When it's no longer fun it's not worth it.

As outlined in our terms of service "We" being "APB" , "You" being the customer. 

By signing up you acknowledge you have read, understood and agree to these terms and conditions. 

We may update our terms of service at any time. 

 

Aussie Punting Battler ("APB") is not a bookmaking or wagering website. As such we do not provide bookmaking or wagering services. We are a tipping and information service site only. If you choose to take tips or use information on this website, you acknowledge that horse racing is a risk and agree that you will at your own risk. We are a fun entertainment service only. APB does not give financial advice and is not a financial service. It is the full responsibility of you, the subscriber, to set their own "unit" value and limits they are comfortable with. We take no responsibility or liability for losing selections and only provide refunds if the subscriber is unable to access the content. If a subscriber is unable to access the content, for whatever reason, and misses a race APB takes no liability for any said loss of possible income.

 

You, the user, must be at least 18 years old. By signing up you confirm you are 18+. 

While we believe in our system they are purely suggestions and not a guarantee. Past performance is no indicator of future performance. 

Any odds quoted are reported as accurately as possible. We take no liability for any errors that may occur. 

We will take all reasonable precautions to protect your data, however unfortunately no data transmission over the Internet can be guaranteed as totally secure. Whilst we strive to protect such information, we do not warrant and cannot ensure the security of any information which you transmit to us. Accordingly, any information which you transmit to us is transmitted at your own risk. You agree that you will not do anything that might put the security of your account at risk.

Nothing in the Terms limits or excludes any guarantees, warranties, representations or conditions implied or imposed by law, including the Australian Consumer Law (or any liability under them) which by law may not be limited or excluded.

By using our Services, you agree that APB is not to be held liable for any decisions you make based on any of the Services, information, materials or guidance and any consequences, as a result, are your own. Any bets you place are at your own discretion. Under no circumstances can you hold APB liable for any actions you take nor can you hold us or any of our employees liable for any loss (including indirect loss or lost opportunity), penalties, charges, bills or costs incurred by you as a result of any tips, guidance, advice, materials or techniques used or provided by APB.

 

All our information on both the Website and in Services is informational only. Results are not guaranteed and APB takes no responsibility for your actions, inactions, omissions, choices or decisions. You agree to do your own due diligence when interpreting our data and not relying it only for any choices you do or don't make. 

You agree to indemnify AP for all actions, suits, claims, demands, liabilities, costs, expenses, loss and damage (including legal fees on a full indemnity basis) incurred, suffered or arising out of or in connection with APB's content.

We do not guarantee that the Website will be secure or free from bugs or viruses or any other type of malicious code or software.You are responsible for configuring your technology to access the Website. You should use your own antivirus software.

Refund Policy:

APB has a no return, no refund policy on subscriptions. You may cancel your subscription and ask for your data to be removed, such as name and email which you have a right to remove.

Refunds will only be given if the customer cannot access the content due to technical issues with our service. We have the ability through our system to see if this error does occur. If a situation occurs and we agree to a refund it will be processed within 7 to 14 business days of our confirmation. Any refund will be processed through the payment method subscription was made. The time for you to receive the refund to your payment source will depend on the third party platform terms and conditions. 

The Terms are governed by the laws of Victoria, Australia. In the event of any dispute arising out of or in relation to the Website or Services, you agree that the exclusive venue for resolving any dispute shall be in the courts of Victoria, Australia.

Responsible Gambling Policy:

Even though we are not a wagering site we take Responsible Gambling seriously. Please make sure you gamble in a responsible manner. If we are contacted by someone associated with you indicating you may have a problem with gambling we will review the evidence and may suspend or cancel your membership if we believe it is in your best interest.

Battlers Break

We offer a service in which you can unsubscribe or take a break from our service at any time. Simply email us and we will accomodate any requests. We fully support anyone who wants to take a break from the entertainment of horse racing.

Cancellation of Membership

We reserve the right to cancel any membership at any time for any reason. 

The emails are for the entitled subscriber only. Suspected retransmission or forwarding to unauthorised third parties (including but not limited to Social Media) without written consent will see memberships cancelled without warning or refund.

Competitions 

At times "APB" will offer free give away promotions to followers. These giveaways comply with Victorian law.

By entering into any of these give aways you agree to the terms and conditions. 

 

1. By entering you agree you are an Australian resident and are 18 years or older.  You may be asked to prove this upon request within 60 days.

2. APB has full discretion in choosing the winner of said competition. 

3. Winners will receive the prize within 28 days.

4. Winner will be announced on the platform of the promotion. 

5. There is no cost associated with entry or claiming a prize. However, you MUST have an Australian bank account (in your name) to receive the prize. If you cannot provide this information you cannot be paid. In this case your prize will be donated to charity if you cannot provide this information within 60 days.

6. The winner gives consent to be named as the winner.

7. The competition is in no way endorsed or sponsored by the platform it is run on. 

8. Any give aways are not actual bets. Prize is calculated based on odds but not an official wager of any sort.

9. Any sponsors of APB take no legal liability for any competitions. 

10. If you are unsure of any terms and conditions please do not enter before contacting us with your questions. 

Battler of the Year 2022

1. Same a 1-10 above

2. Entries will be judged by an independent judge

3. No friends or family may enter Battler of the Year 2022.

4. Winner announced Oct 28 via social medial. Winner will be contacted by email by 5pm on said day.

5. Free swing horse will be selected by APB.

We work hard to provide the most up to date and correct information. We often quote "when tipped" prices based on the price the horse was when we found it and sent to subs. We tip early so this doesn't take into account deductions and may vary on what price the subscriber found due to many reasons out of our control (eg .the time they used the information).

Aussie Punting Battlers will not charge any fee for your access request, but may charge an administrative fee for providing a copy of your Personal Information.

In order to protect your Personal Information we may require identification from you before releasing the requested information.

It is an important to us that your Personal Information is up to date. We  will  take reasonable steps to make sure that your Personal Information is accurate, complete and up-to-date.
